UPDATED: Maguire Alleges Vote Counting Errors in DFL Endorsement Challenge

Mike Maguire may challenge former Sen. Jim Carlson in a primary campaign, according to a news release issued Wednesday.

 

In a formal challenge filed Wednesday with the state's DFL party, Eagan Mayor and District 51 candidate Mike Maguire asked the party to vacate its endorsement of fellow candidate Jim Carlson.

Maguire ran against Carlson, a former state senator, in a hotly contested campaign for the DFL endorsement for the District 51 seat earlier this year. At the endorsement convention in March, Carlson took 200 delegate votes, or 60.06 percent of the ballots, against Maguire's 133 delegate votes, or 39.94 percent.

But in a news release issued Wednesday, Maguire alleged that a series of vote-counting errors at the party's endorsement convention contributed to his defeat by Carlson. Last week, convention organizers and party officers discovered a series of failures to report or count votes cast for Maguire in three of the convention's four ballots, Maguire said.

"We don't make this decision easily or take its ramifications lightly," Maguire wrote in a letter to convention delegates. "When a highly contested endorsement is decided by a single delegate vote and well-documented errors threaten the integrity of the process and the credibility of its outcome, it's important that DFLers continue to stand by the belief that every vote matters."

Earlier this year, both Maguire and Carlson said they would abide by the party's endorsement process and discontinue their campaigns if they did not receive the endorsement.

But Maguire indicated in the press release that he may campaign against Carlson in a primary election.

"When a tight convention comes down to one delegate on the fourth ballot, it's troubling that votes weren't being counted or reported to delegates throughout the day," Maguire wrote.

Although Carlson acknowledged that there were voting errors during the endorsement convention, the errors likely corrected themselves over the course of four ballots and weren't significant enough to change the outcome of the convention, he said.

Maguire "was looking for a reason to run in the primary and renege on his pledge to abide by the endorsement," Carlson said. "We kind of suspected that this was going to be the mayor's intention because he was very reluctant to give his promise to abide by the endorsement."

A primary campaign, Carlson said, would be "devastating" for the DFL in the swing district.

"What happens when you have this kind of thing is that you’re focusing on someone who’s on your own team, rather than an opponent," Carlson said. "We could lose the district."

The state DFL party will review Maguire's claims, Minnesota DFL spokesperson Kate Monson said on Wednesday. DFL officials will likely collaborate with local party members to get all the facts on the table before proceeding, Monson added.

"We're always in favor of following through and making sure the matter is resolved," Monson said.

The GOP is giddy with delight about this. It's precisely why I chose to opt out of the arcane endorsement process. It was bound to come to a primary battle, one way or another. Maybe Dems should just cede the election to the Republicans (the likely outcome on the heels of protracted in-fighting and deep division) and save money and aggravation.

Barb and others, please stop the grousing! Democrats will NOT cede the election and they WILL take back this seat come November, come Hell or High Water! Our internal dispute aside, the people of Eagan and Burnsville - actually most Minnesotans - are sick of the sweet-faced lies and duplicity they have seen from our do-nothing-for-jobs-or-people Republican Legislature. The future health of Minnesota's businesses, communities, people and environment each depends on us working hard to make sure this change happens come November!

Maguire came off as abrasive and a bully at the convention. He needs to respect those of us who were at the convention and support Carlson not help Daley. Carlson won all 4 counts. Shame on you Mike.

Having been at the convention I can only say the man is way too full of himself. Had the voting been closer maybe but Maguire NEVER led or was close on ANY of the four ballots. The balloting went, first ballot Jim Carlson 200 Maguire 156, second ballot Jim Carlson 197 Maguire 151, the third ballot Jim Carlson 191 Maguire 141, fourth and final ballot Jim Carlson 200 Maguire 133. If the DFL loses this race it will be on Maguires head! Put your ego to bed and let our district get on with it. Took you less than 20 minutes to pack up and leave the convention. Certainly not the sign of a person wanting the best for the party.

Second ballot Jim Carlson 197 Maguire 151,
Third ballot Jim Carlson 191 Maguire 141.

Was this the third ballot with the mistake or without the mistake ? If it was with the mistake then the Third ballot would have show only a small dip for Maguire AND Carlson would not have won the nomination.

Gee Deb what are u so worried about a primary about ? Cause common person who can't spend a whole day at a convention may vote for Maguire.

The differences in vote totals you cite were reduced by 8 on the first ballot, 8 on the second ballot, and 6 on the third ballot based on the only three precincts that were re-examined at the requests of delegates. That is hardly insignificant and I defy any Carlson supporter to say they wouldn't demand further investigation if the situation were reversed.

I agree Deb! He huffed out of there without finishing the convention or sticking around to let his team vote for the House race; he came off as a sore loser and that's exactly what he is. His behavior just makes it clearer that Jim was the right choice and still is.

Did any of you attend the ballot examination last Monday? I did. All three precincts requested by delegates to be re-examined were misreported in favor of Carlson. That is a 100% error rate. Don't you think that's worth further investigation?

You ask "Did any of you attend the ballot examination last Monday?" Well none of us were invited to or even knew about this unofficial not-sanctioned examination of ballots long after the ten day challenge period was up. Challenges and vote recounting is supposed to be done by the DFL State Constitutional committee not a random subset of people under uncontrolled conditions.

Mike needs to show a little graciousness and humility. He needs to put party before personal ambition. As I recall, by the rules, he had 10 days to challenge the ballots and we are way past that now. If we lose this race to Daley, there is no doubt the district voters will recall how Mike conducted himself. If Mike supports Jim Carlson and he wins, this will reflect well on Mike and be remembered when it is his turn.

In the process, a Maguire teller had to and did sign off on every count on every precinct on every ballot. Maguire is saying his own people made errors. Maguire is asking the DFL to nullify the endorsement because of errors that his own people did and signed off on!

The counting process requires a teller from each campaign sit together. One opens the envelope from the floor, takes out votes and displays the empty envelope. Each takes turns counting the total number of ballots from the precinct, verifying the signatures on the back of the ballot, counting the votes for each candidate. Both tellers must agree and sign verifying the vote count. Designated people also get to watch from the sides. Any problem or issue has an immediate appeal process.

Even if Maguires people signed off, we do not know the circumstances under which they signed off. Were the ballots missing from that envelope for that precinct. and then found later ? Cause under those circumstances, Maguires people did not make errors.

Imagine the world we would leave our children, if we created high trust systems? This has become a painful process. I support Jim Carlson because I see him as dedicate, hard-working and an effective campaigner. I also like Mike Maguire and believe he served well as mayor and will also make a good campaigner.
We need to as a party find a way to make lemonade out of these lemons. A quick primer on Marshall Rosenberg non-violent communcation: At any moment, one can choose to blame or connect. Blame themselves of blame the other. Let us connect with ourselves and each other. We all spent so much time that Saturday because we care and because we share a responsibilty to create a better world. Let us also connect with this emotional drama. People can get blinded by their desire to win. How do we as a local dfl create a trusting community? Imagine how much more likely we are to win if we have trust among ourselves. Do we have some members who got carried away and miscounted in Jim's favor? Is Mike's passion so strong that he really wants to run in a primary and seeks a storyline? I know this may sound hopelessly optimistic, can we create something good from this conflict? Can Senate District 51 emerge from this a stronger organization? This is less about Jim and Mike and more about You and I.

Clearly the mistabulations were significant enough to merit more attention, and even a brief glance at this thread makes obvious that any such review should be elevated above the local Senate District. We have plenty of time to defeat Daley; that should not be an excuse for sweeping our own errors under the rug.

Mike is a person who apparently can't accept a loss and over reacts to a defeat. He would never win against Daley with his explosive behavior. People don't vote for people with volatile personalities. Daley keeps his composure even while lying. If Mike were pushed he would explode. Remember the meltdown Hatch had and lost. He would have won but lost his temper with the election in less than 2 weeks.

Someone is clearly against teachers and I guess all unions. Once again for those who want to eliminate unions the GOP is on your side. Back to the triangle shirtwaist factory era. I have never been in a union but thank them for safe working conditions, 40 hour work weeks, paid holidays/vacations and benefits.

Are union's perfect? No. Do unions look out for their members best interest? Yes. They are no different than those who work on behalf of the 1% AKA the GOP. We need to work together and get people in congress that represent the 99%. Both the DFL and GOP have dirty members. I would prefer a progressive party run by people like Bernie Sanders and Alan Grayson.

I can't believe all of the hate being expressed here. Let's save all that hate and vitriol for Republicans.

As for the people who have said that Mike ought to put party first, let me just say that that is a major problem with politics. Politicians and those of us who elect them are more interested in doing what's best for the party instead of what's best for the people, the city, the county, the state, the nation, or the world. If Mike thinks he can do a better job than Jim, then he needs to keep pushing on. Personally, I think either one could do a decent job.
