Eagan Man Charged With Drive-By Shooting Aimed at Ex-Girlfriend's Bedroom

Police say Alpha Omega Wagar, 21, allegedly shot his ex-girlfriend's bedroom window with a BB gun, though Wagar denied that he did the shooting.

An Eagan man faces felony criminal charges for allegedly shooting through his ex-girlfriend's bedroom window with a BB gun following a "contentious" breakup.

Alpha Omega Wagar, 21, is charged in Dakota County with conducting a drive-by shooting, possession of a firearm by an ineligible person and terroristic threats, all felonies. He's also charged with misdemeanor fourth-degree criminal property damage.

According to the criminal complaint, were called to an Apple Valley home on April 11 on a report of damaged property, and a female resident told police her daughter's bedroom window had been shot.

Officers found four round holes in one bedroom window, the complaint says; they also found broken window glass, and four BBs and divots in the wall where they had hit.

The angle of the holes and divots indicated the shooter would have been in the street, officers said, according to the complaint.

The woman said her daughter had moved back in about a month before the incident, after a "contentious" breakup with her boyfriend, Wagar, the complaint says. She told police he had sent her daughter threatening text messages.

Officers reviewed text messages the daughter allegedly received from Wagar. The messages explicitly and derogatorily referred to him being in her house, breaking things and harming her.

On April 16, officers searched Wagar's residence and vehicle, the complaint says.

In his vehicle they allegedly found BBs like the ones that had shot the window, a BB gun, a slingshot, slingshot BBs and used canisters of carbon dioxide, according to the complaint.

In Wagar's bedroom they allegedly found more BB gun items, and drug paraphernalia, the complaint says.

On April 17, the daughter told police she had received a text message from Wagar asking why she had called police, and when she told him to stop contacting her, he replied with a message that he didn't do anything and it was wrong of her to accuse him. Police say he then asked, [sic] "do u want me to so this wont be for nothing".

Police called Wagar, who allegedly refused to meet in person; they located him and he gave a Mirandized statement.

He allegedly told police that he had a long history with his ex-girlfriend and that she had moved out of his house recently. According to the criminal complaint, he admitted he sent the text messages, that he knew which window was her bedroom window and that all the BB-related items in his vehicle were his. Police say he also admitted he had been the only person in his vehicle.

Wagar allegedly denied shooting the window, however, the complaint says.

The maximum penalty for the combined charges is 30 years, 3 months in prison and a $61,000 fine.

A Dakota County Court hearing is scheduled for Wagar for May 15.

Minnesota court records show that Wagar was convicted of fourth-degree criminal property damage in 2011.
