A Farmington man faces a gross misdemeanor count of indecent exposure after police say he openly masturbated in front of a woman and her child outside of a fast food restaurant in Eagan.
Michael Christopher Schwarzhoff, 29, was arrested just before 1 p.m. on Jan. 23 outside of a business on the 1200 block of Town Centre Drive, according to a criminal complaint filed with the Dakota County District Court.
Officers were called to the scene by a female witness, who told police she and her 3-year-old had parked outside the restaurant to eat lunch. During her lunch break, the witness said she made eye contact with a man sitting in a four-door sedan parked in the adjacent stall.
When the woman turned around a second time, she noticed the man was holding a cell phone in his hand, and that he allegedly appeared to be masturbating. The woman told police he made no attempt to hide himself, according to the complaint.
An Eagan police detective arrived at the scene and knocked on the window of the man's vehicle, the complaint said. At that point, the officer noticed that the suspect's pants appeared to be unzipped, and that his genitalia were plainly visible.
Police handcuffed and arrested the man, identified at Schwarzhoff, and re-adjusted his pants so that he was not exposed, according to the criminal complaint. Schwarzhoff was then transported to the Eagan Police Department.
At the department, police say Schwarzhoff waived his Miranda rights and agreed to speak with investigators. During the question, he allegedly admitted he was masturbating while viewing pornography on his phone. Schwarzhoff, who works in Eagan, was on his lunch break during the incident. The man also told police this was not the first time he had engaged in such behavior, according to the complaint.
In addition to the gross misdemeanor indecent exposure charges, Schwarzhoff also faces one count of misdemeanor indecent exposure and one count of misdemeanor disorderly conduct. If convicted on the gross misdemeanor, Schwarzhoff could face a maximum of one year in jail and $3,000 in fines.
